Terms of Service

These terms are the agreement between you and The Founder's Kit LLC, a Texas limited liability company (“we”, “us”) when you buy or use one of our kits. Buying a kit or using this site means you accept them. We wrote them to be readable; if anything is unclear, ask us before you buy.

1. What we sell

We sell one-time digital products called kits: collections of templates, playbooks, and step-by-step instructions written for AI coding agents to execute and for you to read. A kit is files — it is not software we host for you, not a subscription, and not a managed service. The one exception is the Hosted Starter Kit, which is a monthly subscription because hosting is ongoing — see section 9.

Kits are designed to work with AI coding agents such as Claude Code and Codex. Those names describe compatibility only. We are not affiliated with, endorsed by, or sponsored by the makers of any AI agent, and you need your own AI agent subscription to use a kit.

2. Buying and delivery

  • Payments are processed by Stripe. We never see or store your card number.
  • At checkout you may give us a GitHub username (optional). After payment we invite that account to the kit's private repository — that is one way the kit is delivered.
  • If you skip the GitHub username, your order page provides the kit as a zip download instead. Trouble with either? support@thefounderkit.ai delivers it by hand.
  • You're responsible for entering a correct GitHub username. If it's wrong, contact support and we'll redeliver to the right account.

3. Your license

Your use of a kit is governed by the Kit License, which is part of these terms. Short version: lifetime personal and commercial use in unlimited projects you own, no reselling the kit itself.

4. Your AI, your accounts, your approvals

Kits give instructions to an AI agent that runs on your computer, under your accounts, with your approvals. That means:

  • Accounts your AI helps create (domains, hosting, payment processing, email) are your accounts, on those providers' terms, at those providers' prices.
  • You review and approve the steps your AI takes. You are responsible for the actions you approve and the businesses you launch, including their legality in your jurisdiction.
  • Third-party services change their screens, prices, and policies. A playbook can go stale between our updates; where a step no longer matches reality, your AI and your judgment fill the gap.

Kits report launch milestones. As part of how kits work, your kit reports business facts about its own progress to us — business name, milestone (interview done, domain registered, site live, first customer), date, and site address — tied to your order. Never anything about who runs the business at home. These maintain your business's Founder Record and its badge; nothing appears publicly (the founder wall, spotlights) without your separate OK. Opt out any time: set KIT_RECORD_CONSENT=revoked in the kit's settings file, or email support@thefounderkit.ai with your order number — we also delete reported milestones on request.

5. No professional advice, no entity formation

Kits include templates for things like website terms and privacy pages. They are starting points, not legal, tax, accounting, or financial advice. For advice, hire the relevant professional.

We are not a law firm and not a business-formation service. Buying a kit does not create an LLC, corporation, or any other legal entity, and does not register you for taxes anywhere. Whether and how to form an entity is your decision, made with a licensed professional if you need advice. Our FAQ points at formation resources — those are independent services with their own terms, and we don't control or guarantee them.

Some links to third-party services on this site (for example, LegalZoom) are or may become affiliate links: if you buy through them, we may earn a commission at no extra cost to you. Commissions never change what a service costs you, and we only link to services we would point a founder at anyway.

6. AI agents and their output

Kits are executed by your AI agent, and this site and our kits may point you at AI-generated recommendations, drafts, and plans. AI output can be wrong, incomplete, or out of date — sometimes confidently so. You are responsible for reviewing anything an AI produces before you rely on it, publish it, file it, or spend money on it. We are not liable for decisions made on the basis of AI output that you didn't verify.

7. No guaranteed outcomes

We stand behind what a kit contains — every kit's contents are listed before you buy, and the guide shows exactly how kits run. We do not promise business results — customers, revenue, rankings, or approval of any third-party account — because no honest seller can.

8. Acceptable use

  • Don't share access to a kit's private repository.
  • Don't resell or redistribute kits (see the Kit License).
  • Don't use a kit to build, promote, or operate anything unlawful or harmful. This includes sexual or explicit content; anything that sexualizes a minor; harassment, bullying, threats, or hate toward any person or group; goods or services that are illegal to sell or that break the policies of the providers a kit uses (for example Stripe, Shopify, Vercel, YouTube); fraud, scams, phishing, or impersonation; publishing a person's photo, likeness, or personal information without their consent; and collecting personal information from children or marketing to children in ways the law or those providers forbid.
  • Don't use a kit to reach data, accounts, keys, or infrastructure that aren't your own, including other customers' hosted pages or their data.

Your AI agent is instructed to decline requests that cross these lines and to point you back here. We may remove or edit a hosted page, and may end access, for a violation.

9. Hosted pages (Hosted Starter Kit)

The Hosted Starter Kit bundles a kit (a one-time purchase, yours for life under the Kit License) with monthly-billed hosting: an included free period shown at checkout, then the standard monthly price shown at checkout. Cancel anytime — including during the included period — by emailing support@thefounderkit.ai— we confirm within one business day, you keep the period you're in, and the page comes down when it ends. Cancelling stops future hosting charges and never affects your kit; months already billed aren't refunded.

Some customers run a business page hosted on our site (addresses under /b/). Those pages are built from information the operating family supplies, and that operator — not us — is responsible for what the page says, what it sells, how orders are fulfilled, and for having the right to publish every word and image on it. Payments on hosted pages go directly to the operator through their own payment apps; we never hold or transfer their money. Hosting a page is not an endorsement of the business.

We may remove or edit a hosted page that violates these terms or the law. If you believe a hosted page infringes your copyright or other rights, email support@thefounderkit.ai with the page address, the material you're complaining about, your contact information, and a statement that you own the right in question — we review promptly and take infringing material down.

10. All sales final

Kits are digital goods delivered in full at purchase, and all sales are final, as described in the All-Sales-Final Policy(which also covers duplicate charges, delivery failures, and the Gate Guarantee — the one exception we volunteer). You consent to immediate delivery at checkout. Statutory rights that can't be waived are unaffected.

11. Disclaimers and liability

Kits are provided as is. To the fullest extent the law allows, we disclaim implied warranties, and our total liability to you for any claim connected to a kit or this site is capped at the amount you paid us for that kit. We are not liable for indirect, incidental, or consequential damages; for the acts of third-party services you or your AI use; for AI-generated output you act on without verifying (section 6); or for content that hosted-page operators publish (section 9).

12. Changes

We may update these terms as the product evolves. The effective date above always reflects the current version, and material changes will be noted on this page. Changes apply going forward, not retroactively to a purchase you already made.

13. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Nothing in these terms limits consumer rights that your local law grants you and doesn't let you waive.
